Court thumbs down SM Prime’s petition vs Cebu City gov’t
The Cebu Regional Trial Court has junked the petition for mandamus and prohibition filed by SM Prime Holdings Inc. against the Cebu City government.
SM Prime, the integrated property arm of the family of retail tycoon Henry Sy, filed the petition to stop the Cebu City government from closing down its mall operations and to renew its business permits.
The Cebu RTC denied the petition for being moot and academic as mayor Tomas Osmeña had already approved SM Prime’s application for renewal of business permits for three of its establishments in SM Seaside Cebu.
The Cebu City government, however, denied the 16 other business permits of SM Prime inside the mall due to failure to to comply with the requirements.
According to SunStar, Osmena assured SM Prime he would not shut down the 16 establishments, which has been and will continue to be a responsible partner in the development of the City of Cebu.
